Grossman Green PLLC, a dedicated personal injury law firm based in Louisville, has achieved a significant victory. We are thrilled to announce a jury verdict of $3.38 million in favor of our client.

Our client endured a traumatic brain injury under distressing circumstances, a situation that no one should ever have to face. During a horse trail ride, our client’s horse unexpectedly and uncontrollably took off, leading to a severe fall.

The path to victory was not straightforward, as we had to overcome two motions for summary judgment.

The case was mired in complexities involving the Farm Animal Activity Act (FAAA), a statute which grants partial immunity to farm animal activity operators. Our task was to demonstrate that the incident was due to either faulty equipment for the ride or a failure to match riders with appropriate horses.

Moreover, we tackled the nuanced definitions of comparative negligence within the FAAA, advocating that our client acted as safely and responsibly as possible given the circumstances.

Because of the immunity provisions in the Farm Animal Activity Act and the difficulty lawyers have had getting past summary judgment, this was the first case ever to be tried to verdict on the FAAA since it was enacted in 1996.

After enduring years of litigation and being unfairly blamed for her injuries, our client’s plight was finally acknowledged by the justice system. The jury verdict absolved her of any fault, recognizing that she, as a beginner rider, did everything within her power in a difficult situation.
